Privacy Policy

This privacy policy governs what personal data is collected and how it is processed and used.

1. Data privacy obligation

Session Basel AG (hereafter "the operator") takes data privacy seriously. Under the terms of Article 13 of the Swiss Federal Constitution and the data privacy provisions of the Swiss Federal Law on Data Protection, every individual has the right to the protection of privacy and to protection against misuse of their personal data. The operator shall comply with these provisions. Personal data of the users (hereafter "you") are treated as strictly confidential and neither sold nor passed on to third parties. Personal data includes all the details and information that refer to a specific or identifiable person. In addition to contact details such as your name, telephone number, address and e-mail address, this also includes other details you provide us with, such as your date of birth.

In close collaboration with hosting providers, the operator makes every effort to protect the data bases as effectively as possible against unauthorised access, data loss, misuse or falsification.

2. Processing personal information

The operator only collects, uses and discloses your personal data if this is permitted by law or if you consent to the collection of data (Art. 31 DSG).

A. Processing in anonymous form
For the purely informational use of the website, it is generally not necessary for you to provide personal data or to consent to such use. Various techniques are used on the website with which the operator and third parties engaged by the operator can recognise you when you use the website and, under certain circumstances, track you over several visits.

The following automatically transmitted data is logged by the operator as part of online tracking:

  • Name of the website accessed
  • Date and time of access to a particular website
  • Amount of data transferred
  • Source/reference from where you accessed the page (referrer URL)
  • Technical browser data
  • Operating system used
  • IP address used in anonymised form

This data is only processed anonymously during a purely informative visit to the website (without interaction). The purpose of this processing is to enable you to use the website you are visiting and to check whether the website is displayed optimally. Your IP address is only used for the duration of your visit. The anonymisation was carried out by shortening the IP address so that an individual assignment is no longer possible.

B. Handling of non-anonymised personal data
a) Types of data processed

  • Inventory data (e.g. names, addresses)
  • Contact data (e.g. e-mail addresses, telephone numbers)
  • Content data (e.g. text entries, photographs, videos)
  • Usage data (e.g. websites visited, interest in content, access times)
  • Meta/communication data (e.g. device information, IP addresses)

b) Purpose of the data processing

  • Review of your enquiries and complaints
  • Promotion of our products and services. This includes sending newsletters and programme booklets, media releases, offers and other communications that may be of interest to you.
  • Reviewing and processing applications
  • Assignment of evening helpers/crew
  • Processing of ticket or CLUB VIP orders
  • Carrying out competitions
  • Compliance with regulatory or legal obligations
  • Establishing, exercising and defending our legal rights or taking legal action
  • Exercising legitimate business interests, such as conducting business analysis and maintaining operations
  • Preventing or responding to potential fraud or illegal activity

c) Duration of data storage
Your data will be stored for the provision of the online offer and related services. Thereafter, the data will be retained for the duration of the retention periods specified by law or regulation in relation to the specific data. A statutory retention period of up to 10 years applies, for example, in tax law. In cases where data processing is based on your consent (e.g. newsletter registration), the data is stored until you revoke it.

d) Disclosure of the data
The operator also discloses your data to third parties within the scope of the business activities and the purposes listed above, insofar as this is permitted and appears to be indicated for predominant interests. This concerns service providers of the operator, including commissioned data processors.

The operator uses the services of specialised third parties in order to be able to make use of the digital infrastructure required in connection with the activities and operations. These include, for example, hosting, CMS and ticketing services from selected providers.

The operator uses in particular:

  • Nine Internet Solutions AG: hosting provider, Zurich, Privacy Policy
  • Yoo AG, web agency (commissioned data processor) Website runs via TYPO3 Association (commissioned data processor): CMS system; provider: TYPO3 - the Professional, Flexible Content Management System for users in Europe and elsewhere, Privacy Policy
  • Ticketcorner: Swiss ticketing company, Rümlang, Privacy Policy
  • Opacc Software AG: Enterprise Software Platform, Rothenburg, Privacy Policy
  • MailXpert: Newsletter distribution platform made in Switzerland, Privacy Policy

e) Contact requests
If you contact the operator using the contact options offered (e-mail, contact form, telephone), your details will be stored so that they can be used to process and answer your enquiry. The data you enter in the contact form will remain with the operator until you request the operator to delete it, revoke your consent to store it or the purpose for storing the data no longer applies (e.g. after processing your enquiry has been completed). Mandatory legal provisions - in particular retention periods - remain unaffected.

f) Newsletter subscription

aa) Newsletter subscription
You can subscribe to a newsletter on this website and thus be informed at regular intervals about current events and offers. If you would like to receive the newsletter, the operator requires a valid e-mail address and your choice of language, as well as information that allows the operator to verify that the user is indeed the owner of the specified e-mail address, or that the owner of the specified e-mail address agrees to receive the newsletter. The time of registration and confirmation as well as the IP address are stored. Changes to your data stored with the dispatch service provider are also logged. The data is used exclusively for sending the newsletter and is sent by the operator via the newsletter service provider MailXpert GmbH.

bb) Double-Opt-In and logging
Registration for the newsletter takes place in a so-called double opt-in procedure. This means that after registration you will receive an e-mail in which you are asked to confirm your registration. This confirmation is necessary so that no one can register with other email addresses. The registrations for the newsletter are logged in order to be able to prove the registration process in accordance with the legal requirements.

cc) Cancellation/revocation
You can unsubscribe from the newsletter at any time by clicking on the link "I no longer wish to receive the newsletter" at the very end of the respective newsletter. Your data will then be deleted immediately as part of the unsubscription process.

g) Cookies of the operator
This website uses cookies. These are small text files that are stored on your terminal device. Your browser accesses these files. The use of cookies increases the user-friendliness and security of this website.

aa) Cookiebot
The operator uses the consent management service Cookiebot, of Usercentrics A/S, Havnegade 39, 1058 Copenhagen, Denmark (Usercentrics) as an order data processor. This enables the operator to obtain and manage the consent of website users for data processing. The processing is necessary for the fulfilment of a legal obligation to which the operator is subject (Art. 31 para. 1 in conjunction with Art. 6 para. 6 DSG)). For this purpose, the following data are processed with the help of cookies:

  • Your IP address (the last three digits are set to '0').
  • Date and time of consent. Browser information URL from which the consent was sent.
  • An anonymous, random and encrypted key.
  • Your end-user consent status, as proof of consent.

The key and consent status are stored in the browser for 12 months using the cookie "CookieConsent". This preserves your cookie preference for subsequent page requests. With the help of the key, your consent can be proven and traced.

The functionality of the website cannot be guaranteed without processing.
Usercentrics is the recipient of your personal data and acts as an order processor for the operator.
The processing takes place in the European Union. You can find further information on objection and removal options vis-à-vis Usercentrics directly at: www.cookiebot.com/de/privacy-policy.

Your personal data will be deleted continuously after 12 months or immediately after the termination of the contract between us and Usercentrics.

A distinction is made between the following cookies:

  • Necessary cookies: some cookies are necessary for the functioning of the website as such or certain functions. For example, they ensure that you can switch between pages without losing information entered in a form. They also ensure that you remain logged in. These cookies are only temporary ("session cookies"). If you block them, the website may not work. Other cookies are necessary so that the server can save decisions or entries made by you beyond one session (i.e. one visit to the website) if you use this function (e.g. language selected, consent given, the function for automatic login etc.). These cookies have an expiry date of up to 24 months and may be used without your express consent.

  • Preference cookies: Preference cookies allow a website to remember information that affects the way a website behaves or looks. They remember your preferences when playing embedded videos and allow these videos to function correctly.

  • Statistics cookies: These cookies help website operators understand how visitors interact with websites by collecting and reporting information anonymously. They register statistical data about visitor behaviour on the website and thus help the webmaster with internal analyses.

  • Marketing cookies: The operator and its advertising partners have an interest in controlling advertising to specific target groups, i.e. to display it only to those whom the operator wishes to address. For this purpose, the operator and the advertising contract partners - if you consent - also use cookies that can be used to record the content accessed or contracts concluded. This enables the operator and the advertising contract partners to display advertisements of the operator or the advertising contract partners on the operator's website, but also on other websites, where the operator can assume that you are interested. Depending on the situation, these cookies have an expiry period of between a few days and 12 months. If you consent to the use of these cookies, you will be shown corresponding advertising. If you do not consent to these cookies, you will not see less advertising, but simply any other advertising.

h) Cookies von Drittanbietern

aa) Google Analytics

This website uses the "Google Analytics" service provided by Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA) to analyse website usage by users. The service uses "cookies" (text files), which are stored on your terminal device. The information collected by the cookies is usually sent to a Google server in the USA and stored there.

This website uses IP anonymisation. The IP address of the user is shortened within the member states of the EU and the European Economic Area. This shortening eliminates the personal reference of your IP address. Under the terms of the data sharing agreement between the website operators and Google Inc., Google uses the information collected to evaluate website usage and activity and to provide services relating to internet usage.

You have the option of preventing the cookie from being stored on your device by making the appropriate settings in your browser. It is not guaranteed that you will be able to access all functions of this website without restrictions if your browser does not allow cookies. Furthermore, you can use a browser plug-in to prevent the information collected by cookies (including your IP address) from being sent to and used by Google Inc. The following link will take you to the corresponding plug-in: tools.google.com/dlpage/gaoptout.

Alternatively, you can prevent Google Analytics from collecting data about you within this website by clicking on this link (IMPORTANT: Insert the mentioned opt-out link). By clicking on the above link, you will download an "opt-out cookie". Your browser must therefore allow cookies to be stored. If you delete your cookies regularly, you will need to click on the link again each time you visit this website.

Here you will find further information on data use by Google Inc.: https://support.google.com/analytics/answer/6004245?hl=de

bb) Google Tag Manager

The operator uses the Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
The Google Tag Manager is a tool with the help of which the operator can integrate tracking or statistical tools and other technologies on the operator's website. The Google Tag Manager itself does not create user profiles, does not store cookies and does not perform any independent analyses. It only serves to manage and play out the tools integrated via it. However, the Google Tag Manager records your IP address, which may also be transmitted to Google's parent company in the United States.

cc) Google AdWords

As part of its online marketing measures, the operator uses the online advertising programme "Google AdWords" of Google Inc . (www.google.com). Google sets a cookie (conversion tracking) so that companies that pay Google for the placement of advertisements (so-called advertisers) can determine how many people subsequently purchase the advertised product after clicking on an advertisement. The so-called conversion tracking cookie will only be stored on an end device if you click on an ad placed by Google where the advertiser uses conversion tracking. The conversion tracking cookies expire after 90 days and do not contain any information that can identify you personally. If the cookie has not yet expired and you visit certain pages of an advertiser's website, Google and the advertiser will be able to recognise that you have clicked on the ad and have been redirected to that page. Each advertiser receives a different cookie, so cookies cannot be tracked across advertisers' websites. Cookies for conversion tracking can be deactivated by setting your browser to block cookies from the domain "googleadservices.com". Further information on the associated data processing and objection options can be found here: www.google.com/intl/de/policies/privacy

dd) Google Maps

This website uses the map service Google Maps. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland. To use the functions of Google Maps, it is necessary to save your IP address. This information is usually transferred to a Google server in the USA and stored there. The operator of this website has no influence on this data transmission.

Google Maps is used in the interest of an attractive presentation of our online offers and to make it easy to find the places we indicate on the website.

More information on the handling of user data can be found in Google's privacy policy: https://policies.google.com/privacy?hl=en.

i) Use of social media plugins

aa) Instagram

Our website also contains integrated Instagram functions. These functions are offered by Instagram Inc., 1601 Willow Road, Menlo Park, CA 94025, USA. If you are logged on to your Instagram account, you can link the content of our website to your Instagram profile by clicking on the Instagram button. This allows Instagram to assign the visit to our website to your user account. Please note that, as Provider of this website, we have no knowledge of the content of the data transferred and how they are used by Instagram. For more information, see the Instagram data privacy policy: http://instagram.com/about/legal/privacy

bb) Facebook

This website uses Facebook social plugins which are operated by Facebook Inc. (1 Hacker Way, Menlo Park, California 94025, USA). The links are identifiable by the Facebook logo or by phrases such as “Like” or “Share”, in the Facebook colours (blue and white). Information on all Facebook plugins is available at https://developers.facebook.com/docs/plugins

The plugin creates a direct link between your browser and the Facebook servers. The Operator has no influence on the nature and scope of the information transferred by the plugin to the servers of Meta Platforms Irland Limited. For more information, visit www.facebook.com/help/186325668085084

The plugin informs Facebook Inc. that you have visited this website. Your IP address may be stored during this process. If you are logged on to your Facebook account while visiting this website, the related information is linked to it. If you use the plugin function - for example if you share or like an article - the related information is also forwarded to Facebook Inc. If you want to avoid Facebook Inc. linking this information with your Facebook account, please log off from Facebook before visiting this website.

cc) Facebook Pixel

This website uses the visitor action pixel from Facebook for conversion measurement. The provider of this service is Meta Platforms Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland). However, according to Facebook, the data collected is also transferred to the USA and other third countries.

This allows your behaviour as a site visitor to be tracked after they have been redirected to the operator's website by clicking on a Facebook ad. This allows the effectiveness of the Facebook ads to be evaluated for statistical and market research purposes and future advertising measures to be optimised.

The data collected is anonymous for the operator of this website, the operator cannot draw any conclusions about your identity as a user. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook data usage policy. This enables Facebook to serve advertisements on Facebook pages as well as outside of Facebook. This use of the data cannot be influenced by the site operator.

You can find more information about protecting your privacy in Facebook's privacy policy.

You can also deactivate the "Custom Audiences" remarketing function in the ad settings section. To do this, you must be logged in to Facebook.

If you do not have a Facebook account, you can disable Facebook's usage-based advertising on the European Interactive Digital Advertising Alliance website.

dd) TikTok

The operator uses the TikTok Pixel on our website. The TikTok Pixel is a TikTok Advertiser Tool provided by TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland, and TikTok Information Technologies UK Limited, WeWork, 125 Kingsway, London, WC2B 6NH, United Kingdom (collectively "TikTok"). The TikTok Pixel is a snippet of JavaScript code that allows the operator to understand and track your activity as visitor on the website. The TikTok Pixel collects and processes information about visitors to the website or the devices they use. The data collected through the TikTok Pixel is used to target our advertisements and to improve ad delivery and personalised advertising. For this purpose, the data collected on our website via the TikTok Pixel is transmitted to TikTok. Some of this data is information stored in the device you are using. In addition, the TikTok Pixel also uses cookies to store information on the device you are using. Such storage of information by the TikTok Pixel or access to information already stored in your terminal device only takes place with your consent.

For more information about how TikTok processes personal data, including the legal basis on which TikTok relies and how you can exercise your rights against TikTok, please see TikTok's privacy policy.

ee) YouTube

For embedded videos, the website uses YouTube LLC , 901 Cherry Avenue, San Bruno, CA 94066, USA, represented by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Normally when you visit a website with embedded videos, your IP address is sent to YouTube and cookies are installed on your computer.  However, we have integrated YouTube videos with the extended data privacy mode (in this case YouTube still contacts Google’s DoubleClick service, but according to Google's data privacy statement personal information is not analysed). This means that YouTube does not store any information on visitors unless they watch the video. When you watch a video, your IP address is sent to YouTube and alerts YouTube to the fact that you have watched the video. If you are logged on to YouTube, this information is also assigned to your user account (you can avoid this by logging out of YouTube before activating the video). The operator has no knowledge of and therefore no influence on the collection and use of data by YouTube. For more information, see the YouTube data privacy policy at www.policies.google.com/privacy. For general use and deactivation of cookies, please also refer to the relevant sections in this data privacy statement.

ff) Apple Music

The Apple Music web player is embedded on this website. Apple collects limited information about this website and your interaction with the player. This information collection protects your privacy and is used by Apple to gather information about how the player is used and to improve the player. Although the Player may be embedded in third-party websites, it is provided by Apple. Therefore, Apple may collect information about where and how the Player is used.

In collecting the data, Apple may use cookies or similar local storage technologies to store website data on your device in the web browser profile. To learn how to manage cookies and website data in the Safari web browser, click here (Mac) or here (iOS device). The procedure for other web browsers is available on request from the respective provider. If you disable cookies or local storage, it may affect how the player works, such as whether you can stay logged into Apple Music in your browser.

If you are not logged into Apple Music in your browser and visit this website where the player is embedded, Apple collects information about the player and your activity in the player. This includes, for example, the domain of the page containing the web player, information about your browser or device, general geographic data based on your IP address (only an abbreviated version of the IP address is kept) and the music being played. The data collected in this way is assigned a random identifier that is unique to the web player in your browser and the domain of the page containing the web player. This identifier is reset after one day and is not linked to your Apple ID, if you have one. If you click a link in the player to sign up for Apple Music, Apple will collect the full URL of the page in which the player is embedded as part of that process.

When you are logged into Apple Music in your browser and visit this website where the player is embedded, Apple Music collects data about the player along with another identifier. This identifier is also unique to the web player in the browser, but is identical for all pages where the player is embedded. It is also reset after one day and is not linked to your Apple ID. Information collected includes, for example, the domain of the page containing the web player, information about your browser or device, general geographic data based on your IP address (only an abbreviated version of the IP address is kept) and interactions with player features (other than playback).

When you are logged into Apple Music in your browser and interact with an Apple Music web player (e.g., click on a link or play music), Apple collects information about your activity along with your Apple ID. This allows Apple to customise Apple Music for you and to fulfil its obligations to strategic partners related to the service. For information on how Apple collects and uses data about Apple Music subscribers, please see the Apple Music & Privacy article.

The information collected about the Apple Music web player and your activity on the player is stored as described above for up to two years to allow for trend analysis. For information on how Apple handles data collected while you are logged in, please see the Apple Music & Privacy article.

Apple collects and uses this information in accordance with Apple's Privacy Policy, which can be found at www.apple.com/de/privacy.

gg) Spotify

Functions of the music service Spotify are integrated on this page. The provider is Spotify AB, Birger Jarlsgatan 61, 113 56 Stockholm in Sweden. You can recognise the Spotify plugins by the green logo on this site. You can find an overview of the Spotify plugins.

This allows a direct connection between your browser and the Spotify server to be established via the plugin when you visit this webpage. Spotify thereby receives the information that you have visited our site with your IP address. If you click on the Spotify button while logged into your Spotify account, you can link the content of this page to your Spotify profile. This allows Spotify to associate your visit to this webpage with your user account.

For more information, please see Spotify's privacy policy.

If you do not want Spotify to associate your visit to this website with your Spotify user account, please log out of your Spotify user account.

Embedding of content from other companies

On this website the operator often embed content from other companies, such as music videos from ARTE Concert. These are links that establish a connection directly from this website to the content of external providers. Please note that, by clicking on the link, you are switching to an external provider. The external provider you have accessed is responsible for data privacy. If you have any questions in this regard, please contact the company concerned.

3. Changes to this privacy policy

The operator reserves the right to change the data protection statements if this should be necessary due to new technologies or legal requirements. If fundamental changes are made to this privacy policy, these will be announced on the website.

4. Your Rights As A user: information, correction and deletion

To make it easier for you to control the processing of your personal data, you also have the following rights in connection with the data processing:

  • The right to request information as to whether and what data we are processing about you;
  • the right to correct data if it is inaccurate;
  • the right to request that we delete data;
  • the right to request certain personal data in a commonly used electronic format or transfer it to another data controller;
  • the right to withdraw consent at any time where our processing is based on your consent;
  • the right to obtain, on request, further information necessary to exercise these rights.

If you wish to exercise the above rights, please contact the operator in writing by e-mail; you will find the contact details in point 1. In order to exclude misuse, the operator must identify you (e.g. with a copy of your ID card, unless this is not possible otherwise).

You also have these rights vis-à-vis other entities that work with the operator on their own responsibility - please contact them directly if you wish to exercise rights in connection with their processing.

Please note that conditions, exceptions or restrictions apply to these rights under the applicable data protection law (e.g. to protect third parties or business secrets). The operator will inform you accordingly if necessary.

In particular, the operator may need to process and store your personal data in order to fulfil a contract with you, to protect our own legitimate interests, such as the assertion, exercise or defence of legal claims, or to comply with legal obligations. To the extent legally permissible, in particular to protect the rights and freedoms of other data subjects and to safeguard interests worthy of protection, the operator may therefore also reject a information request in whole or in part (e.g. by blacking out certain content relating to third parties or our trade secrets).

If you do not agree with our handling of your rights or data protection, please let us or our data protection officers (point 1) know. You also have the right to complain to the Federal Data Protection and Information Commissioner of the data protection supervisory authority: data protection supervisory authority.

5. Data security

The operator also uses technical and organisational security measures to protect personal data that is generated or collected, in particular against accidental or intentional manipulation, loss, destruction or against attack by unauthorised persons. The security measures are continuously improved in line with technological developments.
